Privacy Notice For California Residents

Exercise Your California Rights 

This supplement to Public Records Resource’s privacy notice, located at https://publicrecordsresource.com/privacy, is solely for individuals residing in California, referred to as “consumers” or “you”. It has been created in adherence to the California Consumer Privacy Act of 2018 (CCPA) and any definitions outlined in the CCPA also apply to this notice. This notice only applies to visitors, users, and others in the state of California.

Information We Collect

We gather data that can be linked, either directly or indirectly, to a specific consumer, household, or device (“personal information”). This may include information that identifies, describes, or is related to a particular individual. However, the following types of information are not considered personal information:

  • Publicly accessible information from government records.
  • Consumer information that has been identified or aggregated.

Our website obtains the categories of personal information mentioned above from various sources, including:

  • Direct interactions with you, such as forms you fill out or products and services you purchase from one of our network providers, or information you provide when you register on our website to receive communications from us.
  • Indirect interactions with you, such as observing your actions on our website or using site visit recording technology.
  • Information from our marketing partners, gathered in the course of providing services to them.
  • Verification service providers, who help us verify existing information about you and keep our records up to date. These providers also allow us to offer you information about products and services that may interest you.

Use of Personal Information

We may use, sell, or disclose the personal information we collect for a variety of reasons, including:

  • Fulfilling the reason for which you provided the information, such as responding to an inquiry or processing a payment for a product or service.

We will not collect additional categories of personal information or use the personal information we have collected for purposes that are significantly different, unrelated, or incompatible with the purposes for which it was originally collected without providing you notice.

Sharing Personal Information

We may disclose your personal information to third parties for business purposes or sell it, subject to your right to opt out of such sales (see Sales Opt-out and Opt-in Rights of Personal Information). When we disclose personal information for business purposes, we enter into a contract that requires the recipient to maintain the confidentiality of the information and only use it for the purpose of fulfilling the contract. The CCPA prohibits third parties who purchase personal information from us from reselling it unless you have been explicitly informed and given the opportunity to opt out of further sales.

Your Rights and Choices

The California Consumer Privacy Act (CCPA) confers particular privileges on residents of the state with respect to their personal data. The following section outlines these rights and provides guidance on how to assert them.

Data Portability Rights and Access to Specific Information

As a California resident, you have the right to request information from us regarding the collection and use of your personal data over the past 12 months. Upon receiving and verifying your request (via the methods described in the section on Exercising Deletion Rights, Data Portability, and Access), we will provide you with the following:

  • A list of the categories of personal information we have collected about you.
  • The sources from which we obtained this information.
  • The business or commercial purpose for collecting or selling this information.
  • The third parties with whom we have shared this information.
  • The specific pieces of personal information we have collected about you (also known as a data portability request).

If we have sold or disclosed your personal information for a business purpose, we will also provide you with two separate lists: one detailing the sales of your personal information, including the categories of information sold to each recipient; and another listing the disclosures of your personal information for a business purpose, including the categories of information shared with each recipient.

Rights for Deletion Request

As a California resident, you have the right to request the deletion of any personal information that we have collected from you and retained, subject to certain exceptions. Upon receiving and verifying your request (via the methods described in the section on Exercising Deletion Rights, Data Portability, and Access), we will delete (and instruct our service providers to delete) your personal information from our records, unless an exception applies.

There are certain circumstances under which we may deny your deletion request. These include instances where retaining the information is necessary for us or our service providers to:

  • Complete a transaction or provide a requested service.
  • Take actions that are reasonably anticipated in the course of our ongoing business relationship with you, or fulfill the terms of a written warranty or product recall conducted in accordance with federal law.
  • Detect and prevent security incidents, malicious activity, fraud, or illegal activity, or prosecute those responsible for such actions.
  • Debug products and identify and repair errors that impair existing intended functionality.
  • Exercise free speech or the right of another consumer to do so, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act.
  • Conduct scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, if the information’s deletion would likely seriously impair the research’s achievement and you previously provided informed consent.
  • Make internal and lawful uses of the information that are compatible with the context in which you provided it and reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.

 

Exercising Deletion Rights, Data Portability, and Access

In order to exercise your access, data portability, and deletion rights as described above, you (or someone legally authorized to act on your behalf) may submit a verifiable consumer request to our data protection officer via email at privacy@titaninteractive.net. You may also make a verifiable consumer request on behalf of your minor child.

Please note that you are only permitted to make a verifiable consumer request for access or data portability twice within a 12-month period. When making such a request, you must provide sufficient information to allow us to verify your identity or authority to act on your behalf. This may include a detailed description of your request.

We will not be able to respond to your request or provide you with personal information if we are unable to verify your identity or authority to make the request, or if the personal information requested does not relate to you.

It is not necessary to create an account with us in order to make a verifiable consumer request. We will only use the personal information provided in such a request to verify the requestor’s identity or authority to make the request.

Response, Timing, and Format

We will strive to respond to a verifiable consumer request within 45 days of receipt. If we require additional time (up to 90 days) to respond, we will notify you in writing and explain the reason for the extension.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will provide our written response by mail or electronically, at your preference.

Any information we disclose will only pertain to the 12 months preceding the receipt of the verifiable consumer request. If we are unable to fulfill a request, we will explain the reasons why in our response. For data portability requests, we will provide your personal information in a readily useable format that allows you to transfer the data from one entity to another without difficulty.

We do not charge a fee to process or respond to verifiable consumer requests, unless the request is excessive, repetitive, or manifestly unfounded. If we determine that a fee is warranted, we will explain our decision and provide you with a cost estimate before completing the request.

 

Sales Opt-out and Opt-in Rights of Personal Information

If you are 16 years of age or older, you have the right to request that we do not sell your personal information at any time (the “right to opt-out”). We do not sell the personal information of consumers whom we know to be under the age of 16. Consumers who have previously opted in to the sale of their personal information may choose to opt out of future sales at any time.

To exercise your right to opt out, you (or your authorized representative) may submit a request to our data protection officer via email at privacy@titaninteractive.net or by clicking the following link: Do Not Sell My Personal Information.

Once you make an opt-out request, we will wait at least 12 months before asking you to reauthorize the sale of your personal information. However, you are free to change your mind and opt back in to the sale of your personal information at any time by contacting us at the email address provided above.

You do not need to create an account with us in order to exercise your opt-out rights. We will only use the personal information provided in an opt-out request to review and fulfill the request.

Non-Discrimination

We will not discriminate against you or treat you unfairly for exercising any of your rights under the California Consumer Privacy Act (CCPA). Unless the CCPA allows us to do so, we will not:

  • Refuse to provide you with goods or services.
  • Charge you different prices or rates for goods or services, including through the offering of discounts or other benefits or the imposition of penalties.
  • Provide you with a lower level or quality of goods or services.
  • Suggest that you may be eligible for different prices or rates for goods or services, or a different level or quality of goods or services.

 

Other California Privacy Rights

Under California’s “Shine the Light” law (Civil Code Section § 1798.83), users of our website who are California residents have the right to request certain information about our disclosure of personal information to third parties for their direct marketing purposes. Our Privacy Notice Changes


We reserve the right to alter this privacy notice at any time and at our discretion. Whenever we make changes to this notice, we will post the updated version on our website and update the effective date. By continuing to use our website after the posting of any changes, you are signifying your acceptance of those changes.
